Labor Certifications Part 1: Job Preference Categories

Are you an employer considering whether to sponsor your employee for permanent residency in the United States? Are you an employee trying to determine whether you qualify for a green card and what the process entails? The first thing that you will need to do in either scenario is to determine what job preference category your employee (or yourself) fits into.

Brown Immigration Law has created a number of summary sheets that attempt to simplify the process of determining what specific job preference category works for you. These preference categories are outlined in the Immigration and Nationality Act and for the majority of employees, break into the following:

  • EB-1 : Priority Workers
  • EB-2: Advanced Degree Professionals
  • EB-3: Professionals and Skilled Workers

While there are additional categories that can also serve as a route through which employees can obtain permanent residency (EB-4 Special Immigrant Religious Workers; EB-5 Investors), the majority of individuals fit into one of these three categories.
