What is Humanitarian Parole?

The U.S. Citizenship and Immigration Services (USCIS) is the government organization responsible for overseeing the lawful immigration of foreign nationals into the United States on a temporary or permanent basis. Most individuals must go through standard immigration process of obtaining a visa outside the US and travel to the US where the visa is presented for inspection to gain legal entry into the states. There are certain circumstances which could make it necessary for an otherwise ineligible individual to visit the United States. Without the availability of humanitarian parole, that is not possible. The USCIS can be asked to authorize temporary humanitarian relief to a foreign national in any of the following situations:

  • To visit a family member who has sustained fatal injury or contracted a serious injury from which he or she is unlikely to recover
  • To attend the funeral of a deceased family member
  • To obtain urgent and proper medical care, which is otherwise unable in your home country
  • To give testimony as a key witness in a trial being held here in the U.S.

Not all individuals will qualify for humanitarian parole. This type of immigration relief is only granted in limited circumstances and is not a substitute for any other type of visitor or temporary visa. If you or family member is granted humanitarian parole, it is important you adhere to the specific restrictions and time limitations imposed by the USCIS. Generally permanent residency or other immigration status is not permitted to be pursued while in the U.S. under humanitarian parole. Temporary work authorization is often permitted if the circumstances of your stay merit employment.
